3. INFORMATION ON THE PROCESSING OF PERSONAL DATA

The General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the European Council of 27 April 2016, (hereinafter, “GDPR”)), and Law no. 58/2019, of 8 August ensure the protection of individuals with regard to the processing of personal data and the free movement of such data within the European Union.

Under applicable Law, “personal data” means “any information relating to an identified or identifiable natural person (the “data subject”). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as, for example, a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.”

Personal data provided by the User through this website will be processed in accordance with the applicable legislation on the protection of personal data, under which REPUBLICA acts as the data controller.

No personal data relating to racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, data relating to health and sex life, genetic data, biometric data or data relating to sexual orientation will be requested.

The data may also be shared with third parties when required by law, including  police, regulatory authorities, courts, government bodies or other public authorities, or entities providing Cloud services and maintenance of IT systems.

 

4. PURPOSES AND LEGAL BASIS FOR THE PROCESSING OF PERSONAL DATA

Personal data processed through this website will only be used for the purposes identified below:

REPUBLICA has implemented the appropriate technical and organisational security measures to ensure the security of the personal data provided by the User, in order to prevent its alteration, loss, unauthorised processing and/or access, taking into account the current state of technology, the nature of the data stored and the risks to which they may be exposed. REPUBLICA also regularly reviews and updates its security measures to ensure ongoing effectiveness.

REPUBLICA guarantees the confidentiality of the data provided through this website. Data collection is carried out in a secure manner that prevents any loss or manipulation.

All data is stored in a Secure Server that encrypts/encodes the information (transforms it into a code). The User can verify in his browser if a website is secure by checking that the address beggins with https (instead of http), or by looking for a padlock symbol in the browser, noting that no Internet security measures are completely impregnable.

The User’s personal data is processed with the level of protection legally required to guarantee its security, in line with the current state of technology, implementation costs, and the nature, scope, context and purposes of the processing, as well as the risks, both in probability and severity, to the rights and freedoms of the data subject. In the event of a personal data breach, REPUBLICA has procedures in place to promptly assess, contain, and, if necessary, notify the competent supervisory authority and affected Users, in accordance with applicable law.

Whenever REPUBLICA processes personal data, it undertakes to:

• Store all data using legally required security measures, of a technical and organizational nature, that guarantee their security, thus preventing unauthorized alteration, loss, processing, or access, in line with the current state of technology, the nature of the data and the possible risks to which it is exposed;
• Implement mechanisms to control access to information systems and data, as well as mechanisms to log actions taken by employees, customers and other users of information systems;
• Use mechanisms for encryption, pseudonymization and anonymization of personal data, where and when appropriate;
• Implement physical security measures to protect facilities; and
• Ensure that data is processed only by employees whose intervention is necessary to fulfil the request of the data subject, and who are bound by the duty of secrecy and confidentiality. If personal data is disclosed to third parties for the purposes mentioned in this Policy, such third parties are obliged to maintain the same level of confidentiality.

10. SUPERVISORY AUATHORITY

In accordance with applicable law, the data subject has the right to lodge a complaint regarding the protection of personal data with the competent supervisory authority, the Portuguese Data Protection Authority (Comissão Nacional de Proteção de Dados – CNPD), at www.cnpd.pt.
